You live in California and you own an auto that is still covered under warranty and is now having problems with your electrical system and ignition switch on your Audi. Will the california lemon law cover this car even though it’s not brand new?

Not being a ca lemon law attorney it’s hard for me to answer that lawfully. But I can answer that from the viewpoint of a layman that has seen countless people deal with the mega auto manufacturers and watch them try to fight them. It sometimes seemed, for so many of these people, like an insurmountable task. If you speak to the right people, you can ensure that you will be compensated for your ‘lemon’ vehicle. Let me rewind here and I’ll tell you the story.

Mr. Smith (of course that’s not his real name) never had to concern himself with what exactly the lemon law entailed. Why should he? The car he owned, even though it was nearly a year old, had only a small issue with the engine stopping right after he first bought it. And that went away all by itself. All’s well that ends well, right? Not!

Nearly one year into his Audi, the engine just stopped again all by itself. He was concerned there was something wrong, obviously, so he brought it into the Audi dealership. They told him it was minor and to pick up the car at 5:00. He did just that; it started up perfectly; and he was a happy camper. He was convinced he didn’t have to concern himself with the California Lemon Law.

The next morning he hopped into his car to go to work and the car started. He put it in reverse and the Honda’s engine died again. He started it up and put the car in reverse and got out of his driveway. But it wasn’t a mile or so and the engine died again.

Once again, he went back to his home, called the dealership and brought the car in for service. This time they gave him a loaner car and told Mr. Smith that they would call him when they fixed his automobile.

Days went by. Finally he got a call and he picked up his car. He put his keys in the ignition and he wasn’t out of the lot and the engine stalled out again. He was finished with this and called a California Lemon Law Attorney. Within thirty days, without any money out of his pocket, Mr. Smith got compensated for everything he had paid for the car, his down payment and got himself another new car.

You don’t have to tolerate a vehicle that is a lemon if you live in the state of California. Be aware of your rights and contact a lemon law attorney. You will immediately discover if you quality for this law. And if you do, go for it!

What a situation for the california lemon law this was! And although this seems strange, it is true. I witnessed it first hand and because of the law makers in California and a very good attorney who specialized in this law, this person got remunerated for all his time and trouble.

Not being an attorney, all I can do is to relate to you the experience I saw regarding this car and how this couple took care of it.

Mr. and Mrs. Jones (fictitious names) bought their beautiful, brand new Audi A-6. They couldn’t wait to get in, bring it home and show their family what they bought. It was their dream car and they waited a long time to be able to afford it. They were blissful. They never heard of the California lemon law and they didn’t have to. They were very happy with their car.

Let’s fast forward 9 months in the future. The Jones’ have had their beautiful Audi in the repair shop every other month from the first week they brought it home. So how did all this begin? Well, it should have begun by going to see a california lemon law attorney.

Mr. Jones would go away on business for several days at a time. A week after bringing the Audi home, he left the car in the airport parking lot for 3 days. When he returned, the car started up but then died on him. That was the beginning of a relationship with that repair shop that he never figured he would have to have.

Let there be no doubt this is a beautiful car. I have only one issue with this car and its somewhat of a big one- its in the shop every 3 months. A few weeks after leasing this car I went to start it up at the airport after being gone a few days. It died. Took it in and Audi service found nothing wrong with it.

Audi service looked at it again and tried to convince me that’s the way these cars are. It continued to die and had to be taken in again. This time it was faulty fuel injectors which they replaced under warranty. More recently the gas gauge would fall from 1/4 tank to empty in a matter of seconds. I took it in again to find out it needed a new float in the tank and needed some software upgrades. No problem. Driving home I could smell a very strong odor of gas. This morning I walk into the garage to find my A-6 above an enormous puddle of gasoline. I’ve had it with this thing.

The california lemon law, officially known as the Song-Beverly Consumer Warranty Act is one of this state’s major laws which directly aid the consumer. If you’ve purchased a vehicle in California and you believe you have a lemon, then this is the law for you. And remember, this doesn’t just cover automobiles but trucks, SUVs, vans, recreational vehicles, boats, motorcycles, etc. In fact, any vehicle that you paid more than $25 for is not used for business and is still under warranty is eligible to be covered under this law. Obviously, in your opinion it is also unsafe, has defective parts that cannot be fixed and is malfunctioning. This qualifies your vehicle as a lemon.

Okay, we’ve established that you probably have a lemon. Now what do you do? According to this california lemon law lawyer you should contact the vehicle manufacturer as well as the dealership and let them know that you have a problem with the vehicle. The dealer will then tell you to bring it in and they will attempt to repair it. After 4 attempts, if the vehicle still has the same issue and can’t seem to be repaired and has been in the repair shop for more than 30 days (not necessarily consecutive) then you are ready to file a claim under this law. The only exception to this rule is if you vehicle’s malfunction could cause bodily harm or even death. Then, on a case by case basis, it will be determined if you have to bring it 4 times to be repaired. Many times they lower that number to 2 times or even just once.

If you are now at this step, then you probably should get yourself a good attorney. Make sure that they specialize in the california lemon law attorney and that is what they do full time. Do not turn your case over to someone who is a part time lawyer or who only does lemon law cases as part of a much bigger practice. This is your money and your lawsuit. You have to hire someone that knows this law and all its intricacies so they can best represent you and your situation.

The best case scenario is finding an attorney who will do a free case evaluation and represent you without any out of pocket expense. How this works is that if you qualify, they will begin the process and hopefully settle the case (which can take from 7-60 days) and how you pay them is a percentage from whatever amount the attorney wins for you. In most cases you will receive reimbursement of money you paid for monthly vehicle payments, rental cars, towing and also you will get a new replacement vehicle of the same make and model.
